1. Introduction
Welcome to CarGar ("Platform", "we", "us", or "our"), operated by CarGar, based in Dubai, United Arab Emirates. These Terms & Conditions ("Terms") govern your access to and use of the CarGar website at cargar.me and our mobile applications (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
2. About CarGar
CarGar is an online marketplace that connects vehicle owners ("Clients") with automotive service providers ("Garages") in the UAE. We facilitate the process of requesting, comparing, and booking car services. CarGar acts solely as an intermediary platform and does not itself provide automotive repair or maintenance services.
3. Eligibility & Accounts
- You must be at least 18 years of age to use the Service.
- You must provide accurate, current, and complete information during registration.
- You are responsible for maintaining the confidentiality of your account credentials.
- Each person may hold only one Client account and/or one Garage account.
- We reserve the right to suspend or terminate accounts that violate these Terms or contain fraudulent information.
4. Client Terms
4.1 Service Requests
Clients may submit service requests describing their vehicle issues. These requests are distributed to matching Garages on the platform. CarGar does not guarantee the availability, pricing, or quality of any Garage's services.
4.2 Quotes & Booking
Garages may respond to your request with quotes. By accepting a quote and completing payment, you enter into a direct service agreement with the Garage. CarGar is not a party to this agreement.
4.3 Payments
- All payments are processed securely via Stripe in AED (UAE Dirham).
- Payment is required at the time of booking unless otherwise stated.
- Some services may require a second payment upon completion if additional work is needed, subject to your approval.
5. Garage Terms
5.1 Registration & Onboarding
- Garages must complete the onboarding process, including providing valid trade license information and business details.
- Garages may be required to sign a service agreement via electronic signature (DocuSign) as part of onboarding.
- All information provided must be accurate and up to date.
5.2 Service Obligations
- Garages are responsible for providing services as described in their quotes.
- Garages must honor confirmed appointments and communicate any changes promptly.
- CarGar reserves the right to remove Garages that consistently receive negative feedback or fail to meet service standards.
5.3 Payouts & Commission
- CarGar deducts a platform commission from each completed service payment before disbursing funds to the Garage.
- The current commission rate is displayed in your Garage dashboard.
- Payouts are processed upon withdrawal request, subject to review.
6. Platform Fees & Currency
All prices on the platform are displayed in AED (UAE Dirham) unless otherwise specified. CarGar may charge service fees, which will be clearly disclosed before payment. Additional fees such as car pickup charges may apply and will be shown on the invoice.
7. Cancellations & Refunds
- Cancellation policies vary by service and Garage. Please review the specific terms before booking.
- If a Garage fails to provide the agreed service, you may be eligible for a refund. Contact our support team at office@cargar.me.
- Refunds, when approved, are processed to the original payment method and may take 5-10 business days.
8. Messaging
The platform provides a messaging system for communication between Clients and Garages. Messages must be professional and related to the service. CarGar reserves the right to monitor messages for quality assurance and to remove inappropriate content.
9. Intellectual Property
All content on the platform, including but not limited to the design, logos, text, graphics, and software, is the property of CarGar or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.
10. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Provide false or misleading information.
- Attempt to circumvent the platform to arrange services directly with Garages encountered through CarGar.
- Interfere with or disrupt the Service or its infrastructure.
- Scrape, harvest, or collect data from the platform without authorization.
- Impersonate any person or entity.
11. Limitation of Liability
CarGar acts as an intermediary and does not perform automotive services. To the maximum extent permitted by UAE law:
- CarGar is not liable for the quality, safety, or legality of services provided by Garages.
- CarGar is not liable for any direct, indirect, incidental, or consequential damages arising from use of the Service.
- Our total liability shall not exceed the amount you have paid to CarGar in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless CarGar, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
13. Modifications to Terms
We may update these Terms from time to time. Material changes will be communicated via email or platform notification. Continued use of the Service after changes constitutes acceptance of the revised Terms.
14. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.
